ENTERPRISE— An Enterprise man accused of raping a teenage girl has been denied the chance to bond out of the Coffee County Jail.

Pablo Hugo Fidelino Mendoza, 23, faces one count of first-degree rape. He was denied bond after Wednesday’s initial appearance before Coffee County District Judge Josh Wilson.

Mendoza has been in Coffee County Jail since he was arrested on Monday. He was accused of raping a teen in February 2023 who could not consent due to her being “physically helpless or mentally incapacitated,” according to a complaint filed in the Coffee County court system. 

No further details about the incident have been released. 

Alabama law states that incapacity can take many forms. It includes a person who is mentally or developmentally disabled and lacks the requisite intelligence to knowingly consent.

The term incapacitated also includes people who are temporarily incapable of either appraising or controlling the conduct as a result of the influence of either alcohol or some other incapacitating substance such as drugs.

The third type of incapacitation is when somebody is physically incapacitated that is there either unconscious, asleep, or physically limited and unable to communicate whether or not they wish to engage in sex. Thus a person who is paralyzed to such a degree that they cannot consent to sex would be considered incapacitated and sex with a person such as this could result in charges for rape in the first degree.

Mendoza’s arrest caught the attention of Enterprise native Congressman Barry Moore. 

“My prayers are with this young girl and her family,” he said. 

Mendoza will appear for a pretrial detention hearing set for April 4 at the Enterprise Courthouse.
