Paul Atkins, the chair of the Securities and Exchange Commission (SEC), has unveiled plans to revamp the agency’s cryptocurrency policies. According to Reuters, Atkins aims to establish guidelines for the distribution of crypto tokens deemed securities and is considering whether additional exemptions are necessary.
During a public meeting of the SEC’s crypto task force, Atkins also suggested that the SEC might adjust its rules to allow registered broker-dealers with an alternative trading system (ATS) to facilitate trading in non-securities, such as Bitcoin and Ethereum, the two largest cryptocurrencies. “A key priority of my chairmanship will be to develop a rational regulatory framework for crypto asset markets that establishes clear rules of the road for the issuance, custody, and trading of crypto assets while continuing to discourage bad actors from violating the law,” Atkins stated.
Atkins, who took office last month, emphasized his commitment to creating a solid foundation for digital assets and keeping politics out of securities laws. The crypto industry has long been at odds with regulators over the application of federal securities laws to digital assets, with many arguing that most crypto tokens resemble commodities more than securities. If classified as securities, firms would need to register with the SEC and disclose certain information to investors.
President Donald Trump, who has positioned himself as a “crypto president,” has vowed to reverse the previous administration’s crackdown on the industry. Under former President Joe Biden, the SEC had initiated several lawsuits against crypto companies, including Coinbase and Kraken, for allegedly violating its rules. The new SEC leadership has agreed to halt or withdraw many of these cases.
Republican SEC Commissioner Hester Peirce leads the SEC’s crypto task force, which is responsible for developing rules and guidance for the sector.
