Georgia's Six-Week Abortion Ban Upheld

Updated Oct. 24, 2023 7:26 pm ET

Georgia’s highest court on Tuesday upheld a law banning abortion after about six weeks of pregnancy, a decision that will keep abortion access significantly constrained throughout most of the South.

A 6-to-1 majority of the Georgia Supreme Court rejected a claim by abortion providers that the law, enacted in 2019, was clearly unlawful when it was passed because Roe v. Wade, which protected the right to an abortion, was the law of the land at the time.
